Conditions of Carriage 2024

Important Notice

The customer may not always be entitled to full compensation for any loss and must maintain appropriate insurance. Seek professional advice to ensure adequate coverage.

1. Definitions

• Customer: The individual or company contracting the carrier’s services.
• Contract: The agreement between the customer and the carrier.
• Consignment: Goods sent in one load by or for the customer.
• Dangerous Goods: Items that are hazardous and subject to regulatory conditions.
• Force Majeure Event: Circumstances beyond the carrier’s control, such as natural disasters or government actions.

2. Parties and Sub-Contracting

• The customer must own or be authorized to handle the consignment.
• The carrier can subcontract services. Any additional carriers’ names will be provided upon request.

3. Dangerous Goods

• Dangerous goods must be disclosed in advance and meet statutory regulations. Failure to do so gives the carrier the right to rescind the contract.

4. Loading and Unloading

• The customer and consignee are responsible for loading and unloading goods.
• The equipment used must be suitable and operated by trained personnel.
• Unsafe sites or improper equipment can lead to indemnification by the customer.

5. Customer Obligations

The customer ensures the consignment:

1. Meets legal and safety requirements.
2. Includes accurate details such as weight and contents.
3. Provides the carrier access to necessary welfare facilities.

6. Transit

• Transit begins after the consignment leaves the premises.
• Ends upon delivery or when conditions like inadequate access delay delivery.

7. Undelivered or Unclaimed Consignments

• The carrier can sell consignments after reasonable notice to recover costs.

8. Charges

• Charges must be paid promptly. Late payments are subject to additional fees under the Late Payment of Commercial Debts Act.

9. Liability

• The carrier’s liability is limited to specified conditions.
• Force majeure events absolve the carrier of liability.

10. Indemnity

The customer ensures the consignment:

• Insufficient packaging.
• Fraud or misrepresentation.
• Handling dangerous goods improperly.

11. Confidentiality

Both parties agree to maintain confidentiality unless required by law.

12. Governing Law

This agreement is governed by English law, with disputes settled exclusively in English courts.
